Purpose and Scope

"netzspannung.org" is a non-commercial Internet platform for the production and procurement of media-cultural works and contents that is offered and operated by Fraunhofer-Gesellschaft zur Förderung der angewandten Forschung e.V. (FhG), Schloss Birlinghoven, 53754 Sankt Augustin, Germany.

Data Protection Provisions / Personalized Access

If you wish to participate in "netzspannung.org" as an active User, your registration, complete with your personal data (name, first name, postal address, e-mail address) is required. FhG needs this data to manage your account. Your name will be included in all contributions that you transmit to "netzspannung.org" for publication on the Internet.
Additional personal data will only be published with your prior consent in connection with your participation in the "netzspannung.org" platform. FhG agrees to treat all personal data as confidential, and to use them only for the administration of "netzspannung.org".
Data will not be disclosed to third parties, unless your prior consent has been obtained, or unless required by government regulations or court orders. By accepting these Terms of Use you grant your consent to the collection, processing, and use of your personal data by FhG for the purposes indicated above.
FhG reserves the right to exclude users from further use of the platform, if inaccurate information has been provided.

Copyright

By providing a contribution to FhG for publication on "netzspannung.org", you grant your consent to FhG to save and file the contributions in a database, present them on the Internet, and disseminate them in electronic form, on data carriers, or in a print format. You also grant your consent to the processing of your contributions, either in the form of editorial modifications or technical adjustments. In particular, FhG reserves the right to shorten contributions, to edit them, and to display them using various interface technologies. You acknowledge that your contribution may not be published in the form provided by you.
The consent to the exploitation of the contributions in the manner outlined above shall include the granting of the relevant rights of use to FhG.
The rights of use granted shall apply to all material made available on or after the date of registration and shall also apply to any material that will be made available at a later date to FhG.
Under the condition that the non-commercial purpose of the platform in accordance with par. 1 shall be retained, the rights granted shall also take effect to the benefit of any other legal entity in the event that the "netzspannung.org" project will be discontinued by FhG.

Indemnity

By providing a contribution to FhG for publication on "netzspannung.org", the contributor warrants, in particular, that your contribution does not infringe any third party rights.
You agree to hold FhG harmless from and against any third party claims that are raised on the grounds of violations of a copyright, data protection acts, and/or unfair competition acts, or based on factual errors in substance of the contribution provided.

Rights to Delete

FhG reserves the right to delete contributions with unethical or unlawful content, in particular, any data with pornographic or racist content that is exchanged or stored, to refrain from posting them in the "netzspannung.org" database or presenting them on the Internet, and to permanently exclude the contributor from participation in "netzspannung.org".
Please note that you are personally liable for your contributions under criminal and civil law (cf. § 5 par. 1 German Treaty on Media Services (Staatsvertrag über Medinedienste) and § 5 par. 1 Online Services Act (Teledienstegesetz).

Liability for Accuracy

FhG takes no warranty for the accuracy, completeness and topicality of the "netzspannung.org" contents - especially for the contributions of its users or other third parties - or of the communication between the users exchanged within "netzspannung.org". Any corresponding liability is excluded.

Hyperlinks

There will be hyperlinks to other web pages on the "netzspannung.org" pages. FhG expressly declares that it has absolutely no influence over the presentation and contents of the hyperlinked pages. Therefore, FhG expressly dissociates itself from the contents of the hyperlinked pages presented on "netzspannung.org" and does not assume liability for these web pages. This statement refers to any and all hyperlinks used on "netzspannung.org". FhG does not grant any warranty for the accuracy and topicality of the data contained in the linked web pages.

General Provisions

With regard to any contribution that is sent to FhG in order to be published on "netzspannung.org" you may not claim a right to publication. FhG also reserves the right to delete any contents previously published.
The entire data store of "netzspannung.org" will be virus-checked at regular intervals. However, the use of anti-virus software on your operating system in order to prevent any damage is strongly recommended.
FhG does not assume any liability for damage that occurs in spite of this warning.
FhG does not assume any liability for damage incurred by using the software recommended in connection with "netzspannung.org", as damage claims must be asserted against the respective manufacturer.

Termination

You have the right to terminate the rights of use granted herein by giving one (1) month's notice to take effect at the end of a calendar month. The notice of termination must be in writing and may be sent by mail or fax.

Governing Law

These Terms of Use are exclusively governed by German law.

Escape clause

If any provision of these Terms of Use is or should become invalid in whole or in part, the remaining terms and provisions shall remain in full force and effect. In this case, the parties shall substitute the invalid provision with a valid provision that most closely matches the purpose of the invalid provision.
